International Arbitration
We act as counsel in complex international commercial arbitrations seated in major arbitration hubs, including Singapore, Hong Kong and Dubai (DIFC). Our experience encompasses institutional and ad hoc proceedings under leading rules, involving high value claims, technically complex disputes and multi jurisdictional issues. We assist clients from early case assessment through to hearings, awards and enforcement. Representative cases include:
- Representing the main contractor of a major international airport terminal building (a joint venture of international contractors including Greek and Turkish companies), in two Abu Dhabi-seated arbitrations, upstream against the employer, and downstream against a specialist mechanical electrical and plumbing (MEP) subcontractor, arising out of the design and construction of the airport terminal building in United Arab Emirates
- Representing a global mobility company in multiple New Delhi-seated ICADR arbitrations (and related Indian High Court proceedings, with Indian counsel) against a state-linked employer arising out of the design, construction, testing and commissioning of the World Bank-funded national railway systems project in India, the Eastern Dedicated Freight Corridor Project (claims in excess of US$120 million)
- Representing an international contractor in a Singapore-seated arbitration against its joint-venture partner arising out of a joint-venture agreement for the development of a mass transit rail project in Southeast Asia
- Representing a PRC contractor in a Hong Kong-seated arbitration (and potential investment treaty claims) against the Government of Mongolia arising out of the construction of an ADB-funded road project in Mongolia.
- Representing a Japanese contractor in Singapore-seated arbitrations against the employer arising out of the design, installation, testing and commissioning of two combined cycle plants under the Senoko Phase II Repowering Project in Singapore.
- Representing a European-headquartered floating storage and regasification unit (FSRU) provider in a Singapore-seated SIAC arbitration against an Asian state-owned natural gas company arising under a long-term lease, operation and maintenance agreement for an FSRU.
- Representing a French defence contractor in multiple Singapore-seated ICC and SIAC arbitrations against an Italian company relating to the supply of navigational and electronic equipment for the construction of new navy frigate vessels.
- Representing a global telecommunications company in a Hong Kong-seated arbitration against a Hong Kong telco service provider relating to the design, construction, installation, testing and commissioning of a 2G/3G mobile telecommunications network in Hong Kong.
- Representing a resort development company in Singapore-seated SIAC arbitration against a real estate asset management company arising under an asset management agreement relating to a refurbished luxury resort in the Maldives.
- Representing a global pharmaceutical company in a Hong Kong-seated HKIAC arbitration (and related Hong Kong Court proceedings) against a BVI-incorporated, Hong Kong-listed, and PRC-based company arising under a share-subscription agreement for the manufacture and sale of animal health products in Mainland China. The dispute involved alleged breaches of information rights and other director’s duties.
Paul is also regularly appointed by parties and leading institutions (including SIAC, HKIAC, ICC and others) as arbitrator. Representative cases include:
- Sole arbitrator in an ICC arbitration between an Italian company and two Indian companies on a dispute relating to a dredging and construction contract
- Sole arbitrator in a consolidated SIAC arbitration between a German company and a PRC company on a dispute relating to the supply of electronic transmission and other equipment
- Sole arbitrator in an SIAC arbitration between a Dubai company and an Indonesian company on a dispute relating to a coal supply contract involving Indonesian steam-coal
- Co-arbitrator in an ad hoc arbitration between a Danish company and an Indian company on a dispute relating to multiple steel and other supply contracts
Mediation
We act as counsel and as mediators in institutional and ad hoc mediations in Singapore, Hong Kong, Dubai and internationally. We assist parties in reaching commercially grounded outcomes through structured negotiation, informed by a clear understanding of legal risk and procedural realities. Representative cases include:
- Representing an Asian consortium of electricity generation and utility companies in a HKIAC mediation in Hong Kong against the main contractor of multiple EPC contracts arising out of the development of an offshore Liquefied Natural Gas (LNG) project in Asia (claims in excess of US$70 million).
- Representing a global mobility company in an SIMC mediation in Singapore with a main contractor relating to the supply of signalling system and platform doors on the Singapore MRT project (claims in excess of S$20 million).
- Sole mediator in an SIMC mediation in Singapore between the Indonesian subsidiaries of a Mainland PRC company and a Chinese-European joint venture company on a dispute relating to a geothermal project in Indonesia (amount of dispute in excess of USD 30 million). Secured a settlement agreement between the parties after a 20-hour bilingual mediation.
Commercial Litigation
We act in complex commercial litigation as part of a broader disputes canvas. Our team appears as advocates and solicitors before all levels of the Singapore courts and works closely with foreign counsel in cross border disputes. We are frequently instructed in matters where litigation interfaces with arbitration, regulatory proceedings or parallel actions in other jurisdictions.
Project Counselling
We provide active project counselling on projects worldwide, including front end advisory support where appropriate. Our role often involves identifying and managing dispute risk, shaping claims and defences, and advising on dispute strategy while projects continue. This work draws on sectoral experience, contractual analysis and commercial judgment.
Dispute Avoidance and Adjudication
We advise on dispute avoidance strategies throughout the life cycle of FIDIC based and other complex projects. We are regularly involved in adjudications and dispute board processes, acting both as counsel and as appointed neutrals. Our focus is on resolving issues efficiently and authoritatively, while allowing projects and commercial relationships to continue where possible.
